San Diego employment firm Blumenthal Nordrehaug Bhowmik De Blouw LLP has initiated a class action lawsuit against TRS Restaurants, Inc., alleging the company systemically denied staff mandated meal and rest breaks while failing to reimburse employees for the business-related use of personal cellular devices.

The complaint, filed in San Diego Superior Court under Case No. 26CU026275C, claims the restaurant operator routinely required staff to work through scheduled thirty-minute off-duty meal breaks. According to the filing, employees frequently worked shifts exceeding five hours—and in some cases ten hours—without receiving the legally required first or second meal periods. Plaintiffs further allege the company utilized time-rounding practices to suppress penalty payments, effectively forcing staff to forfeit compensation for missed breaks.

Beyond meal period allegations, the lawsuit asserts a violation of California Labor Code § 2802. The firm contends that TRS Restaurants required employees to use personal mobile phones to complete job duties but neglected to provide reimbursement for the associated costs.
